WE COLLECT LIMITED PERSONAL INFORMATION FROM CHILDRENAs required by the Children’s Online Privacy Protection Act of 1998 (“COPPA”), Company will not condition a Child’s participation in an activity on the Site on a Child disclosing more Personal Information (defined below) than is reasonably necessary to participate in such activity. Therefore, a Child can visit the Site, view much of its content, and take advantage of many features on the Site without the Child providing individually identifiable information of the Child or his or her parents (“Personal Information”) (for example, first and last name, e-mail or postal address or telephone number). Note, a user name that is not an actual name is not Personal Information under COPPA so you may be able to age gate at registration and limit registration for those under 13 such that no Personal Information is collected. One-time UseFor certain activities or features made available through the Site, Company may request and collect online contact information (typically, an e-mail address) of a Child for one-time use of that information. For example, Company may collect a Child’s online contact information to respond directly to a Child’s specific request, such as answering a question submitted by the Child through the Site, or allowing a Child to enter a sweepstakes. Such information is collected when the Child provides it to us directly such as through an online form or e-mailing us. After the Child’s online contact information is used once in connection with the specific purpose for which it was collected, we delete the online contact information from our records and do not use it to re-contact the Child.
Send-To-A-Friend FunctionalityThe Site may provide users the opportunity to send electronic postcards or similar content to their family and friends. We may ask for a first name, but we do not require Children to submit Personal Information about themselves in order to send an electronic postcard or similar content. Such features will not include the ability for Children to include free-form text messages absent verified parental consent. In the event electronic postcards or similar functionality is made available on the Site, we will, however, ask Children to submit information (typically first name and e-mail address) of the recipient of such electronic postcards or e-mail messages, which we use solely for the purpose of sending the requested content to the recipient and then we delete that information.
Other Features That Collect Personal Information From ChildrenIf a Child wishes to participate in other features made available through the Site that require the collection of Personal Information from a Child, we will ask the Child to provide the name and e-mail address (or other contact information) of the Child’s parent or legal guardian (collectively, “Parent”) in order to provide notice and obtain consent from the Parent as required by COPPA.
Information We Collect As You Access And Use The SiteIn addition, the Site automatically collects information about all individuals’ use of the Site whenever someone visits or interacts with the Site (“Site Usage Information”). Use of InformationCompany may use a Child’s Personal Information or Site Usage Information: (1) to provide a Child with information or services or process transactions that the Child has requested or agreed to receive, including to send the Child electronic newsletters, which may include such from third parties subject to verified parental consent; (2) to enable a Child to participate in a variety of the Site’s features such as online entry sweepstakes; (3) to improve the Site or our services, to customize the Child’s experience on the Site, or to serve the Child specific content that is most relevant to the Child; (4) to contact the Child with regard to the Child’s use of the Site and, in our discretion, changes to the Site and/or Site’s policies; (5) for internal business purposes; (6) for purposes disclosed at the time the Child provides their information or the parent provides verified parental consent (as applicable), or as otherwise set forth in this Children’s Privacy Policy.
Further, we may use third party analytics and other service providers to evaluate and provide us with information about the use of the Site and viewing of our content. DISCLOSURE OF CHILDREN'S PERSONAL INFORMATION Service ProvidersOther than as specifically provided elsewhere in this Children’s Privacy Policy, we do not disclose Children’s Personal Information to third parties, except we may disclose Children’s Personal Information to service providers who provide support for the internal operations of the Site and who do not disclose or use the Personal Information for any other purpose. These service providers may provide support services such as hosting the Site, designing and/or operating the Site’s features, tracking Site analytics or performing other administrative services. We may provide these companies with access to Children’s Personal Information in order for them to carry out the services they are performing for the Child on our behalf. PARENTAL NOTIFICATION AND CONSENTWhen a Child is asked to provide Personal Information to us other than for so-called one-time uses (as discussed above), we will first collect the Child’s Parent’s e-mail address and use this information to contact the Parent by e-mail to notify the Parent that their Child wishes to provide Personal Information to us. The notice will describe the purposes for which the Personal Information is collected, and provide the Parent with an opportunity to decline our collection of the information from the Child.
In our e-mail to the Child’s Parent, we will typically attach our Parental Consent Form which must be completed, signed and returned to us either by regular mail or by fax as indicated on the Parental Consent Form. If we receive a completed and signed Parental Consent Form from a Parent, we will e-mail the Child and give them instructions on how they can access the Site activity they requested to participate in. In certain internal purposes, COPPA permits us to obtain parental consent via e-mail, followed by a subsequent confirmation from the parent, and we may obtain parental consent for such purposes by that method.
